Terms of Service

REALTIONSHIP OF THE PARTIES

The Technician is an independent contractor, and shall not be deemed to be an employee of the Client. No agency, partnership, joint venture, or employee-employer relationship is intended or implied by this agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this agreement. The Technician, collected data or any other deliverables prepared by the Technician, shall not be deemed a ‘work for hire’ as defined under
Copyright Law. All rights granted to Client are contractual in nature and are expressly defined by this agreement.

AT THE SHOOT

Your input is important when choosing what to capture. If you or an authorized representative cannot be at the shoot, the technician will use his or her best judgment and experience to decide how best to capture the property, and this shall be deemed acceptable by the Client. Properties should be properly staged and cleaned before the technician arrives. Staging sheet will be provided upon request.

FEES

All agreed upon fees and expenses are due at the time the assets are delivered. Reality Capture Experts, LLC reserves the right to cancel, postpone, or refuse to schedule subsequent shoots until the account is made current.

CANCELLATIONS/RESCHEDULING

Unless otherwise stated in writing, Reality Capture Experts, LLC requires a 50% down payment at the time of scheduling. Deposit is refundable, less 50% or $450 if cancelled or postponed within 48 hours of scheduled services. No refunds will be processed if canceled or postponed without 48 hours notice. This fee is to compensate our Technician and staff for lost wages.

In the case where no deposit is made or required, the full shoot amount will be assessed if:

(1) the Technician arrives at the property to find the shoot is canceled (including denied access to the property and the property not being ready) and (2) if canceled or postponed on the day of the scheduled shoot.

If 48 hours notice is not given, there will be a 50% fee assessed per unit/property, for each Technician scheduled. This fee is to compensate our Technician and staff for lost wages.
